1. Agreement to Terms

By accessing or using Recon Vue (“the Service”), operated by Motivito (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Recon Vue is a recon operations platform designed for automotive dealerships and recon teams. It provides pipeline management, inspection workflows, task tracking, vendor coordination, and reporting tools accessible via web browser.

3. Accounts and Access

Access to the Service requires an account created by an authorized organization administrator. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at hello@recon-view.io if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable law.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Reproduce, distribute, or sublicense the Service without our prior written consent.
• Submit false, misleading, or fraudulent data or content through the Service.

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and designs — are the exclusive property of Motivito and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

6. Your Data

You retain ownership of all data, content, and information you submit to the Service (“Your Data”). By using the Service, you grant Motivito a limited, non-exclusive license to process Your Data solely to provide and improve the Service. We do not sell Your Data to third parties. 7. Subscription and Billing

Certain features of the Service are available on a paid subscription basis. Subscription fees are billed in advance on a recurring cycle as agreed at the time of purchase. All fees are non-refundable except as required by applicable law or as expressly stated in a separate agreement. We reserve the right to change pricing with reasonable prior notice.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms. You may also terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, Motivito shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, goodwill, or other intangible losses arising from your use of the Service.

11. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by updating the effective date at the top of this page and, where appropriate, by sending you an email. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation or, if unresolved, through binding arbitration.
